2. Applicability

These Terms of Service apply to every offer, order and agreement made through our webshop.

By placing an order, you confirm that you have read and agree to these Terms.

3. Products

We sell:

• Live plants
• Plant accessories
• 3D-printed accessories and other related products

Because plants are living organisms, every plant is unique. Variations in:

• size,
• colour,
• variegation,
• leaf shape,
• number of leaves,
• and minor cosmetic imperfections

are natural characteristics and do not constitute defects.

Product photos are intended as examples unless otherwise stated.

4. Availability

All products are offered subject to availability.

If an item becomes unavailable after your order has been placed, we will contact you as soon as possible and provide the option of:

• a refund, or
• an alternative product (if available).

5. Prices

All prices displayed on our website include VAT where applicable.

Shipping costs are shown separately before checkout.

We reserve the right to change prices at any time. However, the price paid at checkout will always apply to your order.

6. Orders

A contract is formed once you receive an order confirmation by email.

We reserve the right to refuse or cancel orders where:

• payment cannot be verified;
• incorrect pricing has occurred due to technical errors;
• fraudulent activity is suspected;
• products are unavailable.

7. Payment

We accept the payment methods displayed during checkout, including but not limited to:

• iDEAL
• PayPal
• Apple Pay
• Google Pay (where available)

Orders will only be processed after payment has been successfully received.

8. Shipping

We currently ship within the European Union.

Estimated delivery times are provided for guidance only and are not guaranteed.

We are not responsible for delays caused by:

• shipping carriers;
• customs inspections;
• weather conditions;
• force majeure;
• circumstances outside our reasonable control.

9. Incorrect Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

If an incorrect or incomplete address is provided and the parcel is returned to us, the customer is responsible for any additional shipping costs required to resend the order.

If the parcel cannot be recovered due to an incorrect address provided by the customer, we cannot issue a refund.

10. Right of Withdrawal

Consumers purchasing accessories have the statutory right of withdrawal as described in our Return & Refund Policy.

Live plants are exempt from the right of withdrawal because they are perishable goods under applicable EU consumer legislation.

11. Warranty and Legal Guarantee

Consumers are entitled to the statutory legal guarantee under Dutch and applicable EU law.

If a product does not conform to the agreement, please contact us as soon as reasonably possible after discovering the issue.

12. Limitation of Liability

To the maximum extent permitted by law, ThatPlantSpot shall not be liable for:

• indirect or consequential damages;
• loss resulting from improper care of live plants after delivery;
• delays caused by third-party shipping carriers;
• natural variation in live plants.

Nothing in these Terms excludes liability where exclusion is not permitted under applicable law.

13. Intellectual Property

All content on this website, including photographs, logos, graphics, product descriptions and text, is the property of ThatPlantSpot or used with permission.

No content may be copied, reproduced or distributed without prior written permission.

14. Privacy

Personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

15. Force Majeure

We shall not be liable for delays or failure to perform our obligations where caused by events beyond our reasonable control, including but not limited to:

• natural disasters;
• severe weather;
• strikes;
• pandemics;
• transport disruptions;
• government actions.

16. Governing Law

These Terms are governed by the laws of the Netherlands.

Mandatory consumer protection rights applicable in the consumer’s country of residence remain unaffected.

17. Dispute Resolution

The European Commission previously operated an Online Dispute Resolution (ODR) platform, but it has been discontinued. Consumers may still contact their national consumer authority or use other available dispute resolution mechanisms where applicable.
